Introduction
These Terms of Service (“Terms”) govern your use of the Dawar mobile app and related services (“Dawar”, the “Service”).
Dawar is a marketplace that helps car owners in Egypt find spare parts and car-service workshops, and helps shops list and manage them. By creating an account or using Dawar, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility & accounts
- You must be at least 18 years old and able to form a binding contract and use the Service under applicable law.
- You sign in using your phone number (one-time SMS code) and/or a password. You are responsible for keeping your login and device secure and for activity under your account.
- You agree to provide accurate information and keep it up to date.
- A single account can act as both a buyer and a seller.
User responsibilities
As a user of Dawar, you agree to:
- Use the Service lawfully, honestly and respectfully toward other users.
- Provide accurate information in your profile, messages, reviews and orders.
- Independently verify parts, services, compatibility, condition and price with the seller before committing to or completing any deal.
- Arrange and complete any purchase, payment and collection directly with the seller.
- Not misuse contact details obtained through Dawar (for example, for spam or harassment).
- Leave reviews that are honest and based on genuine experiences.
Seller responsibilities
If you operate a shop on Dawar, you additionally agree to:
- Provide accurate shop and business information, and keep your store location and contact details current.
- List only items and services you are legally entitled to offer, with accurate titles, descriptions, condition, compatibility, photos and prices.
- Honour the listings and pickup reservations you accept, and communicate clearly with buyers.
- Comply with all applicable laws, licensing, tax and consumer-protection obligations relating to your sales and services.
- Hold any required registrations; tax or commercial registration numbers you provide must be truthful.
- Understand that shops are reviewed and must be approved before they become publicly visible, and that we may re-review them.
Marketplace disclaimer
Dawar is a discovery marketplace that helps car owners, parts sellers and service workshops find and contact each other. Dawar is not a party to any transaction between a buyer and a seller, does not take possession of any item, does not perform any repair or service, and does not act as agent for either side.
Listings, prices, availability, and the quality, safety and legality of parts and services are the responsibility of the seller. The Service is provided “as is” and “as available”; we do not guarantee availability, accuracy of listings, or the outcome of any deal. Any dispute over a part, a service or a transaction is between the buyer and the seller.
Payments
Dawar does not process any payments and does not handle money. There is no in-app or online payment, wallet, or card processing in Dawar.
Buyers can reserve items as a pickup order. Payment is made directly to the seller, in person, when the item is collected — on whatever terms the buyer and seller agree. Because Dawar is not involved in payment, we do not provide escrow, refunds, chargebacks or payment dispute resolution. Any refund, exchange or warranty is a matter between the buyer and the seller.
If online payments are added to Dawar in the future, these Terms will be updated to describe them before that feature goes live.
Content & ownership
You retain ownership of the content you submit — such as listings, photos, shop details, messages and reviews (“User Content”). By submitting User Content, you grant Dawar a non-exclusive, worldwide, royalty-free licence to host, store, display and use it as needed to operate and promote the Service. You represent that you have the rights to the content you submit and that it does not infringe anyone else's rights.
The Dawar app, website, name, logo, design and software are owned by Dawar and protected by intellectual-property laws. You may not copy, modify, or create derivative works from them except as allowed by law.
Prohibited activities
You must not:
- List or sell counterfeit, stolen, recalled, unsafe or otherwise illegal items or services.
- Post false, misleading, fraudulent or deceptive content, or manipulate reviews.
- Harass, threaten, defraud or impersonate others.
- Infringe intellectual-property or privacy rights.
- Upload malware or attempt to disrupt, overload, hack or reverse-engineer the Service.
- Scrape, harvest or collect data from the Service without permission.
- Create accounts to evade bans, or otherwise abuse the Service.
- Use the Service for any unlawful purpose or in breach of these Terms.
Moderation
To keep the marketplace safe, we may review, approve, reject, hide or remove listings and shops, and we may warn, suspend or restrict accounts that violate these Terms or harm the community. We may act on reports from users and on our own review.
Account termination
- By you: you can stop using Dawar and permanently delete your account at any time — see Delete your account.
- By us: we may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or harm other users or the Service.
- Effect: on termination, your right to use the Service ends. Some provisions — including content licences already granted, disclaimers, and liability limits — survive termination.
Records retained after deletion
When your account is deleted, your personal data is removed as described in our Privacy Policy. We retain only a limited set of records after deletion: records we are legally required to keep (for example, tax and accounting records relating to a seller's business, for the period required by Egyptian law), records needed to resolve an open dispute, and a minimal internal record confirming the deletion and helping prevent repeat abuse. We do not use these records to rebuild your profile.
Disclaimers & limitation of liability
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
- Dawar is not liable for the acts, omissions, listings, parts, services, conduct, or content of any buyer or seller, or for any transaction conducted through or arising from the Service.
- Dawar will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or other intangible losses.
- Aggregate cap. Dawar's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid to Dawar in the 12 months before the event giving rise to the claim (which, while Dawar charges users no fees, is zero), or (b) one thousand Egyptian Pounds (EGP 1,000).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
Indemnity
To the extent permitted by law, you agree to indemnify and hold Dawar harmless from claims, damages, losses and reasonable expenses arising from your User Content, your use of the Service, your dealings with other users, or your breach of these Terms or of any applicable law.
Governing law & disputes
These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-laws rules.
The parties will first try to resolve any dispute informally by contacting each other. If a dispute cannot be resolved, it will be subject to the exclusive jurisdiction of the competent courts of the Arab Republic of Egypt. This does not remove any mandatory consumer-protection rights you have under the law of the place where you live.
General terms
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Dawar regarding the Service.
- Severability. If any provision is found unenforceable, the rest of the Terms remain in full effect, and the unenforceable provision will be applied as closely as possible to its intent.
- No waiver. If we do not enforce a right or provision, that is not a waiver of it.
- Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition or reorganisation.
- Force majeure. Dawar is not responsible for delays or failures caused by events beyond its reasonable control.
- Third-party services. The Service may link to or rely on third-party services (such as maps or WhatsApp); their own terms and policies apply to your use of them.
- Notices. We may provide notices to you in the app or by the contact details on your account; you can reach us at the address below.
Changes to these Terms
We may update these Terms as the product evolves. We will revise the “last updated” date and, where appropriate, notify you in the app. Continued use after an update means you accept the revised Terms.
